Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and ENDVR Co LLC(“ENDVR Co,” “we,” “us,” or “our”) governing your use of endvrco.co (the “Site”) and any purchases made through it. These Terms apply to all visitors, users, and customers.

You must be at least 18 years of age to use this Site or place an order. By using the Site, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding contract. If you are using the Site on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

All canvas art sold on the Site is printed to order. We reserve the right to modify, discontinue, or limit availability of any product at any time without prior notice.

Prices are listed in US dollars and are subject to change without notice. We make every effort to display accurate pricing; however, in the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and issue a full refund.

Product images on the Site are representative. Because every canvas is printed to order, there may be minor variations in color between what you see on your screen and the finished product. Monitor calibration affects how colors appear digitally.

Placing an order constitutes an offer to purchase. Your order is accepted when you receive an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in product or pricing information, or stock limitations. If we cancel an order after payment, you will receive a full refund.

Payment is processed at the time of order through Stripe, Inc. By providing payment information, you represent that you are authorized to use that payment method. We do not store your full payment card details.

You are responsible for any applicable taxes or import duties. Where required by law, sales tax will be collected and remitted.

All products are printed to order by our fulfillment partner (Prodigi Ltd.) and shipped directly to you. Processing time is 3–5 business days. Domestic US delivery is 7–10 business days after processing. These are estimates; actual delivery times may vary.

Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays caused by the carrier, weather, natural disasters, or circumstances outside our control.

Per the FTC's Mail Order Rule: if we are unable to ship within the stated timeframe, we will notify you via email and give you the option to wait or receive a full refund.

Defective or damaged items: If your order arrives damaged or defective, contact us within 7 days of delivery at legal@endvrco.co with photos of the damage. We will send a replacement at no charge. No return shipping required.

Change of mind: Because all products are printed to order specifically for you, we do not accept returns for change of mind. Please review your order carefully before placing it.

Order errors: If we made an error in your order (wrong product, wrong size), contact us within 7 days and we will make it right at no cost to you.

Refunds: Where a refund is owed, it will be processed to your original payment method within 5–10 business days.

All content on the Site — including designs, graphics, typography, photography, copy, and code — is the property of ENDVR Co LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from this Site without our express written permission.

Purchasing a product grants you a personal, non-transferable license to display that product in your home or place of business. It does not grant you any rights to reproduce the design, resell the product, or use the design commercially.

Quotes, philosophical works, and other textual elements used in our designs may be in the public domain or used under applicable doctrines. If you believe any content infringes your intellectual property rights, contact us at legal@endvrco.co.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Site or its systems
• Submit false or fraudulent orders
• Engage in chargeback fraud or other payment fraud
• Scrape, crawl, or harvest data from the Site without permission
• Interfere with or disrupt the Site's operation
• Impersonate ENDVR Co or any other person or entity

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ENDVR CO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that defects will be corrected or that the Site will meet your requirements.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENDVR CO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ENDVR CO IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless ENDVR Co LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Informal Resolution: Before filing any formal claim, you agree to contact us at legal@endvrco.co and attempt to resolve the dispute informally. We will attempt to resolve it within 30 days.

Binding Arbitration:If informal resolution fails, any dispute shall be resolved by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You waive your right to participate in a class action lawsuit or class-wide arbitration. The arbitration shall take place in New Jersey, USA.

Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify you of material changes.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and ENDVR Co regarding your use of the Site and supersede all prior agreements.
